These Terms and Conditions of Sale apply to:<\/p>

(hereinafter referred to as \u201cPOMEG\u201d or the \u201cCompany\u201d).<\/p>

2. Products Offered<\/h2>

POMEG offers several beverage products made from selected ingredients, available according to the offers presented on the website.<\/p>

Products may be purchased through:<\/p>

  • one-time purchases;<\/p><\/li>

  • subscription plans with recurring deliveries according to the selected plan.<\/p><\/li><\/ul>

    The essential characteristics, ingredients, formats, prices, and availability of each product are presented on the website before the customer places an order.<\/p>

    3. Health Disclaimer<\/h2>

    The products offered by POMEG are food products (beverages).<\/p>

    They are not medicines and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.<\/p>

    By placing an order, the customer acknowledges that POMEG products do not have any established therapeutic or medical effect and are not a substitute for professional medical advice, diagnosis, or treatment.<\/p>

    4. Orders and Contract Formation<\/h2>

    Orders are placed online through the website.<\/p>

    The customer selects the desired products and, where applicable, chooses a subscription plan.<\/p>

    Before confirming the order, the customer may review and modify the information provided.<\/p>

    The order is considered accepted once payment has been successfully validated and an order confirmation email has been sent.<\/p>

    The sales contract is concluded upon receipt of this confirmation.<\/p>

    The customer guarantees that all information provided during the ordering process, including delivery details, is accurate and complete.<\/p>

    The Customer may request a refund within thirty (30) calendar days from the date of their first order if they are not satisfied with the Product.<\/p>

    To be eligible for a refund, the beverage pack may have been opened, provided that no more than two (2) cans have been consumed. The remaining cans must be returned to the address provided by the Seller.<\/p>

    Once the returned package has been received and inspected, the refund will be processed within five (5) to ten (10) business days, using the original payment method whenever possible.<\/p>

    Return shipping costs are the sole responsibility of the Customer.<\/p>

    5. Prices and Payment<\/h2>

    Product prices are displayed in euros (EUR) or any other currency available on the website, including applicable taxes.<\/p>

    For one-time purchases, payment is made at the time the order is placed.<\/p>

    For subscription plans, the customer is charged on a recurring basis according to the frequency and conditions of the selected plan.<\/p>

    Accepted payment methods include credit and debit cards and any other secure payment methods made available on the website.<\/p>

    POMEG reserves the right to suspend or cancel orders in the event of non-payment or suspected fraudulent activity.<\/p>

    6. Delivery<\/h2>

    Estimated delivery dates and delivery conditions are provided to the customer before the order is confirmed.<\/p>

    POMEG makes reasonable efforts to meet the estimated delivery dates provided.<\/p>

    If delivery is not completed within the applicable timeframe and the order has not yet been shipped, the customer may contact POMEG to request cancellation and reimbursement where permitted by applicable law.<\/p>

    Delivery shall be deemed completed once the products have been delivered to the address provided by the customer.<\/p>

    The customer is responsible for ensuring that the delivery information provided is accurate.<\/p>

    7. Right of Withdrawal (France Only)<\/h2>

    In accordance with Article L221-18 of the French Consumer Code, consumers located in France have a legal right to withdraw from their purchase within fourteen (14) days.<\/p>

    For subscription plans, this period begins upon receipt of the first order.<\/p>

    In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal may not apply to certain food products that have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection.<\/p>

    Returned products must be unopened, unused, and in their original condition where the right of withdrawal applies.<\/p>

    Return shipping costs may be borne by the customer in accordance with applicable regulations.<\/p>

    8. Subscription Management and Cancellation<\/h2>

    Customers may manage or cancel their subscription at any time through their customer account, where this functionality is available, or by contacting POMEG according to the procedures indicated on the website.<\/p>

    Cancellation applies only to future billing periods.<\/p>

    Any order that has already been billed before cancellation takes effect will be prepared and shipped unless otherwise required by applicable law.<\/p>

    No partial refunds will be issued for subscription periods that have already started.<\/p>

    9. Recipe and Product Changes<\/h2>

    POMEG beverages are made using ingredients whose availability may vary depending on seasonal conditions, harvest availability, or supply constraints.<\/p>

    As part of its commitment to quality and continuous improvement, POMEG may occasionally modify or refine recipes, formulations, packaging, or ingredient sourcing.<\/p>

    Such changes will not affect the essential characteristics of the products and will not automatically entitle customers to refunds, cancellation, or compensation.<\/p>

    10. Customer Responsibilities<\/h2>

    The customer agrees to:<\/p>

    • provide accurate and complete information when placing an order;<\/p><\/li>

    • use products according to their intended purpose and any instructions provided;<\/p><\/li>

    • confirm that they are legally permitted to purchase and consume the products ordered.<\/p><\/li><\/ul>

      11. Liability<\/h2>

      POMEG shall not be held liable for damages resulting from:<\/p>

      • improper use of products;<\/p><\/li>

      • failure to follow usage, storage, or handling instructions;<\/p><\/li>

      • inaccurate information provided by the customer.<\/p><\/li><\/ul>

        POMEG\u2019s liability shall remain limited to direct damages proven to result from a breach attributable to the Company, within the limits permitted by applicable law.<\/p>

        12. Intellectual Property<\/h2>

        All content available on the website, including texts, images, logos, trademarks, graphics, and visual elements, is protected by applicable intellectual property laws.<\/p>

        Any reproduction, representation, or unauthorized use is strictly prohibited.<\/p>

        13. Personal Data<\/h2>

        POMEG processes customers\u2019 personal data in accordance with applicable privacy regulations, including:<\/p>

          If no amicable agreement can be reached, disputes shall be submitted to the competent courts in accordance with applicable rules, including consumer protection provisions where applicable.<\/p>

          POMEG propose \u00e0 la vente plusieurs boissons \u00e9labor\u00e9es \u00e0 partir d\u2019ingr\u00e9dients s\u00e9lectionn\u00e9s, disponibles selon les offres propos\u00e9es sur le site internet.<\/p>

          Les produits peuvent \u00eatre propos\u00e9s selon diff\u00e9rentes modalit\u00e9s :<\/p>

          • achat unique ;<\/li>
          • abonnement avec livraison r\u00e9currente selon la formule choisie par le client.<\/li><\/ul>

            Les caract\u00e9ristiques essentielles, compositions, formats, prix et disponibilit\u00e9s des produits sont pr\u00e9sent\u00e9s sur le site internet avant toute commande.<\/p>

            3. Avertissement sanitaire<\/h2>

            Les produits propos\u00e9s par POMEG sont des denr\u00e9es alimentaires (boissons).<\/p>

            Ils ne constituent pas des m\u00e9dicaments et ne sont pas destin\u00e9s \u00e0 diagnostiquer, traiter, gu\u00e9rir ou pr\u00e9venir une maladie ou une condition m\u00e9dicale.<\/p>

            En passant commande, le client reconna\u00eet que les produits POMEG n\u2019ont aucun effet th\u00e9rapeutique ou m\u00e9dical \u00e9tabli et qu\u2019ils ne remplacent en aucun cas l\u2019avis, le diagnostic ou le traitement recommand\u00e9 par un professionnel de sant\u00e9.<\/p>

            4. Commandes et conclusion du contrat<\/h2>

            Les commandes sont effectu\u00e9es exclusivement en ligne via le site internet.<\/p>

            Le client s\u00e9lectionne les produits souhait\u00e9s ainsi que, le cas \u00e9ch\u00e9ant, une formule d\u2019abonnement.<\/p>

            Avant validation d\u00e9finitive de la commande, le client peut v\u00e9rifier et modifier les informations saisies.<\/p>

            La commande est consid\u00e9r\u00e9e comme accept\u00e9e apr\u00e8s validation du paiement et envoi d\u2019un e-mail de confirmation.<\/p>

            Le contrat de vente est conclu \u00e0 compter de cette confirmation.<\/p>

            Le client garantit l\u2019exactitude des informations fournies lors de la commande, notamment ses coordonn\u00e9es de livraison.<\/p>

            Le Client peut solliciter un remboursement dans un d\u00e9lai de trente (30) jours calendaires \u00e0 compter de la date de sa premi\u00e8re commande, si le Produit ne lui donne pas satisfaction.<\/p>

            Pour \u00eatre \u00e9ligible au remboursement, le pack de boissons peut avoir \u00e9t\u00e9 entam\u00e9, sous r\u00e9serve qu’un maximum de deux (2) canettes aient \u00e9t\u00e9 consomm\u00e9es. Le reste du pack devra \u00eatre retourn\u00e9 \u00e0 l’adresse communiqu\u00e9e par le Vendeur.<\/p>

            Apr\u00e8s r\u00e9ception et v\u00e9rification du colis retourn\u00e9, le remboursement sera effectu\u00e9 dans un d\u00e9lai de cinq (5) \u00e0 dix (10) jours ouvr\u00e9s, selon le mode de paiement utilis\u00e9 lors de la commande.<\/p>

            Les frais de retour demeurent int\u00e9gralement \u00e0 la charge du Client.<\/p>

            5. Prix et paiement<\/h2>

            Les prix des produits sont indiqu\u00e9s en euros (EUR) ou dans toute autre devise affich\u00e9e sur le site, toutes taxes applicables comprises.<\/p>

            Pour les achats uniques, le paiement est effectu\u00e9 au moment de la commande.<\/p>

            Pour les abonnements, le client est factur\u00e9 de mani\u00e8re r\u00e9currente selon la fr\u00e9quence et les conditions de la formule choisie.<\/p>

            Les moyens de paiement accept\u00e9s comprennent notamment les cartes bancaires et tout autre moyen de paiement s\u00e9curis\u00e9 propos\u00e9 sur le site.<\/p>

            POMEG se r\u00e9serve le droit de suspendre ou d\u2019annuler toute commande en cas de d\u00e9faut de paiement ou de suspicion de fraude.<\/p>

            6. Livraison<\/h2>

            Les modalit\u00e9s et d\u00e9lais estim\u00e9s de livraison sont indiqu\u00e9s au client avant la validation de sa commande.<\/p>

            POMEG s\u2019efforce de respecter les d\u00e9lais annonc\u00e9s.<\/p>

            En cas de retard de livraison conform\u00e9ment aux dispositions l\u00e9gales applicables, et lorsque la commande n\u2019a pas encore \u00e9t\u00e9 exp\u00e9di\u00e9e, le client peut contacter POMEG afin de demander l\u2019annulation de la commande et le remboursement des sommes vers\u00e9es lorsque les conditions l\u00e9gales sont r\u00e9unies.<\/p>

            La livraison est consid\u00e9r\u00e9e comme effectu\u00e9e d\u00e8s remise du produit \u00e0 l\u2019adresse indiqu\u00e9e par le client lors de la commande.<\/p>

            Le client est responsable de l\u2019exactitude des informations de livraison communiqu\u00e9es.<\/p>

            7. Droit de r\u00e9tractation (France uniquement)<\/h2>

            Conform\u00e9ment \u00e0 l\u2019article L221-18 du Code de la consommation, les consommateurs situ\u00e9s en France disposent d\u2019un d\u00e9lai l\u00e9gal de 14 jours pour exercer leur droit de r\u00e9tractation.<\/p>

            Pour les abonnements, ce d\u00e9lai court \u00e0 compter de la r\u00e9ception de la premi\u00e8re commande.<\/p>

            Conform\u00e9ment \u00e0 l\u2019article L221-28 du Code de la consommation, le droit de r\u00e9tractation peut \u00eatre exclu pour certains produits alimentaires descell\u00e9s apr\u00e8s livraison et ne pouvant \u00eatre renvoy\u00e9s pour des raisons d\u2019hygi\u00e8ne ou de protection de la sant\u00e9.<\/p>

            Les produits retourn\u00e9s doivent \u00eatre non ouverts, non consomm\u00e9s et dans leur \u00e9tat d\u2019origine lorsque le droit de r\u00e9tractation est applicable.<\/p>

            Les frais de retour peuvent rester \u00e0 la charge du client conform\u00e9ment \u00e0 la r\u00e9glementation applicable.<\/p>

            8. Gestion et r\u00e9siliation des abonnements<\/h2>

            Le client peut g\u00e9rer ou r\u00e9silier son abonnement \u00e0 tout moment depuis son espace personnel lorsque cette fonctionnalit\u00e9 est disponible, ou en contactant POMEG selon les modalit\u00e9s indiqu\u00e9es sur le site.<\/p>

            Toute r\u00e9siliation intervient pour les prochaines \u00e9ch\u00e9ances uniquement.<\/p>

            Toute commande d\u00e9j\u00e0 factur\u00e9e avant la prise en compte de la r\u00e9siliation sera pr\u00e9par\u00e9e et exp\u00e9di\u00e9e, sauf disposition l\u00e9gale contraire.<\/p>

            Aucun remboursement partiel ne sera effectu\u00e9 pour une p\u00e9riode d\u2019abonnement d\u00e9j\u00e0 commenc\u00e9e.<\/p>

            9. Modifications des recettes et des produits<\/h2>

            Les boissons POMEG sont \u00e9labor\u00e9es \u00e0 partir d\u2019ingr\u00e9dients dont la disponibilit\u00e9 peut varier en fonction des saisons, des conditions de r\u00e9colte ou des contraintes d\u2019approvisionnement.<\/p>

            Dans le cadre de son engagement envers la qualit\u00e9 et l\u2019am\u00e9lioration continue, POMEG peut modifier ponctuellement la recette, la formulation, le conditionnement ou l\u2019origine de certains ingr\u00e9dients.<\/p>

            Ces modifications n\u2019affectent pas les caract\u00e9ristiques essentielles du produit et ne donnent pas automatiquement droit \u00e0 un remboursement, une annulation ou une compensation.<\/p>

            10. Obligations du client<\/h2>

            Le client s\u2019engage \u00e0 :<\/p>

            • fournir des informations exactes et compl\u00e8tes lors de sa commande ;<\/li>
            • utiliser les produits conform\u00e9ment \u00e0 leur destination et aux \u00e9ventuelles instructions fournies ;<\/li>
            • v\u00e9rifier qu\u2019il est l\u00e9galement autoris\u00e9 \u00e0 acheter et consommer les produits command\u00e9s.<\/li><\/ul>

              11. Responsabilit\u00e9<\/h2>

              POMEG ne saurait \u00eatre tenue responsable des dommages r\u00e9sultant :<\/p>

              • d\u2019une mauvaise utilisation des produits ;<\/li>
              • du non-respect des instructions d\u2019utilisation ou de conservation ;<\/li>
              • d\u2019informations erron\u00e9es fournies par le client.<\/li><\/ul>

                La responsabilit\u00e9 de POMEG demeure limit\u00e9e aux dommages directs prouv\u00e9s r\u00e9sultant d\u2019un manquement imputable \u00e0 la Soci\u00e9t\u00e9, dans les limites pr\u00e9vues par la r\u00e9glementation applicable.<\/p>

                12. Propri\u00e9t\u00e9 intellectuelle<\/h2>

                L\u2019ensemble des \u00e9l\u00e9ments pr\u00e9sents sur le site internet, notamment les textes, images, logos, marques, contenus graphiques et \u00e9l\u00e9ments de pr\u00e9sentation, est prot\u00e9g\u00e9 par les droits de propri\u00e9t\u00e9 intellectuelle applicables.<\/p>
